1. Information you share with us

We require certain information to provide our services to you. For example, you need to have an account to upload or share content on our Company. When you choose to share the information below with us, we will collect it and use it to operate our services.

You do not need to create an account to use some of the features of our Services, such as searching for and viewing public profiles of users across our Company. If you choose to create an account, you will need to provide us with certain personal data so that we can provide our services to you. At our Company, this includes a display name (e.g., “Moments”), a username (e.g., @Moments), a password, and an email address or phone number. Your display name and username are always public, but you can use your real name or a pseudonym. You can also create and manage multiple accounts with our Company, for example, to express different parts of your identity.

1.2 Public Information

Some of the activity at our Company is public, including your profile information, your time zone and language, when you created your account and your Content, and certain information about your Content such as the date, time, application and version of our Services where you made your Content. You may also choose to publish your location in your Content and on your profile on our Company. If you like, share, respond to, or publicly engage with an advertisement on our Services, that advertiser may thus learn information about you associated with the advertisement you engaged with, such as characteristics of the target audience the advertisement was intended to reach. Your hearts, comments, the number of hearts you've received, votes, the accounts you're a Superfan of, and whether you watched a live stream or replay are also public. Any hearts, comments, or other content you contribute to another account's stream will remain part of that stream for as long as it remains on Periscope. Information posted about you by others who use our Services may also be public. For example, others may tag you in a photo (if your settings allow it) or mention you in Content.

By publicly sharing content through Content, you are directing us to disseminate that information as widely as possible, including through our APIs, and direct those who access the information through our APIs to do the same. To facilitate the rapid global dissemination of Content to people around the world, we use information technologies such as application programming interfaces (APIs) and incorporate them to make some of these available for websites, applications and for other uses - for example, to display Content on a website news or analyze what people say on our Service. We generally make this content available in limited quantities for free and charge licensing fees for large-scale access. We have standard terms that govern how this data may be used and a compliance program to enforce those terms. But these individuals and companies are not affiliated with our Company, and their offers may not reflect updates you make to our Company.

1.3 Contact Information and Address Books

We use your contact information, such as your email address or phone number, to authenticate and maintain your account, and to keep our services, secure and to help prevent spam, fraud and abuse. We also use contact information to personalize our Services, enable certain account features (for example, for access verification or via SMS), to send you information about our Services, and to personalize our Services, including advertisements. If you provide our Company with your telephone number, you agree to receive text messages from our Company at that number, as permitted by the laws of your country. Our Company also uses your contact information to direct marketing to you as the laws in your country allow, and to help others find your account if your settings allow, including through third-party services and client applications. You may use your email and mobile notification settings to control the notifications you receive from our Company. You may also discontinue receiving a notification by following the instructions in the notification or here.

You may choose to upload and sync your contact list to our Company so that we can help you find and connect with people you know, or help others find and connect like you. We also use this information to better recommend content to you and others.

You can register with our Company with an account from another service such as Twitter, Google or Facebook. If you do so, we will use information from this service, including your email address, friends or contact list, to recommend other accounts or content to you, or to recommend your account or content to others. You can control whether your Periscope account is discoverable via email through your Periscope settings.

1.4 Direct Messages and Non-Public Communications

We provide certain features that allow you to communicate more privately or control who sees your content. For example, you can use Direct Messages to have non-public conversations at our Company. When you communicate with others by sending and receiving Direct Messages, we will store and process your communications and related information. This includes checking links for harmful content, mitigating links, detecting spam, abuse, banned images, and using reported issues. We also use information about who you communicate with and when (but not the content of those communications) to better understand your use of our services, to protect the security and integrity of our platform, and to show you more relevant content. We share the content of your Direct Messages with the people you sent them to; we do not use them to serve ads. Please note that if you interact in a manner that is normally public with content on our Services shared with you via Direct Message, for example by liking Content, those interactions will be public. When you use features like Direct Messages to communicate, remember that recipients have their own copy of your communications from our Services - even if you delete their copy of those messages from your account - that they can duplicate, store or reshare .

1.5 Payment Information

You may provide us with payment information, including your credit or debit card number, card expiration date, validation code, and billing address, to purchase advertising or other offers provided as part of our Services.

2. Additional Information We Receive About You

We receive certain information when you use our Services or other websites or mobile applications that include our content and those of third parties, including advertisers. Just like the information you share with us, we use the data below to operate our services.

2.1 Location Information

We require information about your registration and current location, which we obtain from signals such as your IP address or device settings, to securely and reliably set up and maintain your account and to provide our services to you.

Subject to your settings, we may collect, use and store additional information about your location, such as your exact current position or places you have previously used, to operate or personalize our services, including with more relevant content, like local trends, stories, ads, and suggestions for people to follow.

2.2 Links

To operate our Services, we track how you interact with links on our Services. This includes links in emails we send to you and links in Content that appear on other websites or mobile applications.

If you click on an external link or advertisement on our Services, that advertiser or website operator may be able to infer that you came from our Services, as well as other information associated with the advertisement you clicked on, such as characteristics of the audience intended to be reached. They may also collect other personal data from you, such as cookie identifiers or your IP address.

2.3 Cookies

A cookie is a small data file that is stored on your computer or mobile device. Like many websites, we use cookies and similar technologies to collect additional site usage data and to operate our services. Cookies are not required for many parts of our services, such as searching and viewing public profiles. Although most Web browsers automatically accept cookies, the settings on many browsers can be modified to refuse cookies or to alert you when a website is trying to place a cookie on your computer. However, it is possible that some of our Services may not function properly if you disable cookies. When your browser or device permits, we will use session cookies and persistent cookies to better understand how you interact with our Services, monitor aggregate usage patterns, personalize and operate our Services, provide account security, personalize the content we show you, including advertisements, and remember your language preferences. 2.4 Registration Data

We receive information when you view content on or interact with our services, which we call “Registration Data”, even if you have not created an account. For example, when you visit our websites, access our services, interact with our email notifications, use your account to authenticate to a third-party website, application or service, or when you visit a third-party website, application or third-party service that includes content from our Services, we may receive information about you. This Log Data may include information such as your IP address, browser type, operating system, web page of origin, web pages visited, location, your wireless carrier, device information (including device and application IDs) , search terms (including those not submitted as queries) and cookie information. We use the information you provide to us and the data we receive, including Registration Data and third-party data, to make inferences about what topics you may be interested in, your age, and the languages you speak. This helps us to better promote and design our services for you and to personalize the content we show you, including advertisements.

2.5 Data from our Web Services

When you view our content on third-party websites that integrate content from our Services, such as embedded timelines or sharing buttons, we may receive Log Data that includes the web page you visited. We use this information to better understand the use of our services, to protect the security and integrity of our platform, and to show you more relevant content, including advertisements. We do not associate this web browsing history with your name, email address, phone number or username, and we delete, obliterate or aggregate it after 30 days. We do not collect this data from browsers that we believe are located in the European Union or European Free Trade Association countries.

2.6 Advertisers and Other Advertising Partners

Advertising revenue allows us to support and improve our services. We may use the information described in this Privacy Policy to help make our advertising more relevant to you, to measure its effectiveness, and to help recognize your devices so that we can serve ads to you on and off our Services. Our advertising partners and affiliates share with us information such as browser cookie ID, mobile device ID, or cryptographic hash of an email address, as well as demographic or interest data and content viewed or actions taken on a website or app. Some of our advertising partners, especially our advertisers, also allow us to collect similar information directly from their website or application by integrating our advertising technology. Information shared by advertising partners and affiliates or collected by our Services from advertising partner and affiliate websites and applications may be combined with the other information that you share with our Services and that our Services receives about you described elsewhere part of our Privacy Policy.

Our Services adhere to the Digital Advertising Alliance Self-Regulatory Principles for Online Behavioral Advertising (also called “interest-based advertising”) and respect the DAA (Digital Advertising) Consumer Choice Tool Alliance [Digital Advertising Alliance]) so you can opt out of receiving interest-based advertising here. Additionally, our advertising policies also prohibit advertisers from targeting ads based on categories that we consider sensitive or prohibited by law, such as race, religion, politics, sex life or health. If you are an advertiser or potential advertiser, we process your personal data to help offer and provide our advertising services. You may update your details by contacting us directly as described in this Privacy Policy.

2.7 Personalization based on your inferred identity

When you register for our Services with a browser or device, we associate that browser or device with your account for purposes such as authentication, security and personalization. Subject to your settings, we may also associate your account with browsers or devices other than those you use to register for our Services (or associate your signed-out device or browser with other browsers or devices). When you provide other information to our Services, including an email address, we associate that information with your account. Subject to your settings, we may also use this information to infer other information about your identity, for example, by associating your account with hashes of email addresses that share common components with the email address you provided to our Services. We do this to operate and personalize our services. For example, if you visit websites with sports content on your laptop, we may show you sports-related ads on our Android Services, and if the email address associated with your account shares components with another email address, such as shared first name, last name or initials, we may later match ads from advertisers who were trying to access email addresses containing these components.

3. Information We Share and Disclose

As noted above, our Services are designed to widely and instantly disseminate the information you share publicly through these services. In the limited circumstances in which we disclose your private personal data, we will do so subject to your control, because it is important to operate our services, or because it is required by law.

3.1 Sharing Your Control

Notwithstanding anything to the contrary in this Privacy Policy or the controls we may provide you, we may preserve, use, share or disclose your personal data or other security data if we believe it is reasonably necessary to comply with a law, regulation, legal process or governmental request; to protect the safety of any person; to protect the security or integrity of our platform, including to help prevent spam, abuse or bad actors on our services, or to explain why we remove content or accounts from our services8; to address fraud, security or technical concerns; or to protect our rights or property or the rights or property of those who use our services. However, nothing in this Privacy Policy is intended to limit any rights of defense or opposition that you may have in relation to requests from third parties to disclose your personal data, including requests made by a government.

3.4 Affiliates and Transfer of Ownership

If we are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your personal data may be sold or transferred as part of that transaction. This Privacy Policy will apply to your personal data as it is transferred to the new entity. We may also disclose personal data about you to our affiliated companies to help operate our services and the services of our affiliates, including serving advertisements.

3.5 Non-Personal Information

We share or disclose non-personal data, for example, in aggregate data such as the total number of times people engaged with a Content, demographics, the number of users who clicked on a specific link or voted in a poll on a Content (even that only one person has done so), the topics people are interacting about in a specific location, some inferred interests, or reports to advertisers about how many people have seen or clicked on their ads.

4. Managing Your Personal Information with Us

You control the personal data you share with us. You can access or correct this data at any time. You can also deactivate your account. We also provide tools for you to object, restrict or withdraw consent, where applicable, to the use of data you have provided to our Services. And we make the data you share through our services portable and provide easy ways to contact us. Please note that to help protect your privacy and maintain security, we take steps to verify your identity before granting access to your personal information or complying with deletion, portability, or other related requests.

4.1 Accessing or Rectifying Your Personal Data

If you have registered an account on our Services, we make available to you tools and account settings to access, correct, delete or modify the personal data you have provided to us that is associated with your account. You may download certain account information, including your Content.

4.2 Exclusion

We keep Registration Data for a maximum of 18 months. When deactivated, your account on our Services, including your display name, username and public profile, will no longer be visible on our Services for iOS and Android. For up to 30 days after deactivation, you will still be able to restore your account on our Services if it was accidentally or improperly deactivated.

Please remember that search engines and other third parties may still retain copies of your public information, such as your user profile information and Public Content, even after you delete the information from our services or deactivation of your account

4.3 Objection, Restriction or Withdrawal of Consent

When you are signed into your account on our Services, you can manage your privacy settings and other account features here at any time. It may take a while for your privacy settings to be fully reflected in our systems.

4.4 Portability

Our Company provides you with a means to download information you have shared through our services.

Children and Our Services

Our Services are not directed to children, and you may not use our Services if you are under 13 years of age. You must also be old enough to consent to the processing of your personal data in your country (in some countries we may allow your parent or guardian to do so on your behalf).

Our Global Operations and Privacy Shield

To provide our services to you, we operate globally. Where your country's laws permit, you authorize us to transfer, store and use your data in the United States, Ireland and any other country where we operate. In some of these countries to which our Company transfers personal data, privacy and data protection laws and regulations regarding when government authorities can access data may vary from those in the country in which you live.
